Tradeline Account Agreement

INTRODUCTION

This Tradeline Account Agreement ("Agreement") explains the terms that you agree to follow for your open-end line of credit account (the "Tradeline Account"). Before you agree to these terms, you should read this Agreement carefully. Please keep a copy of this Agreement for your records.

IMPORTANT INFORMATION ABOUT BILLING RIGHTS AND ARBITRATION

Billing Rights: Information on your rights to dispute transactions and how to exercise those rights is provided in your account agreement.

The Dispute Resolution by Binding Arbitration section of Credit Genie's Terms and Conditions, available at https://creditgenie.com/terms-and-conditions ("Credit Genie Terms") governs the resolution of claims made under this Agreement unless you (1) are subject to the protections of the Military Lending Act or (2) timely exercise (or exercised) your right to reject arbitration as provided in the Binding Arbitration section. That section requires, with limited exceptions, that all claims be resolved by binding and final arbitration. That section also contains a class action and jury trial waiver.

ABOUT THE TRADELINE ACCOUNT

This document constitutes the agreement between you ("you" or "your") and Creditly Corp. DBA Credit Genie ("Credit Genie", "we", "us", or "our") governing your Tradeline Account ("Agreement"). The Tradeline Account may only be used to purchase certain products and services made available through Credit Genie's platform, which includes Credit Genie's mobile application ("Mobile App") and website.

USING THE TRADELINE ACCOUNT

  1. Initial Purchase and Automatic Renewals of Your Annual Credit Genie Membership. Upon your acceptance of this Agreement and the issuance of your Tradeline Account, you agree to purchase a 12-month Credit Genie Membership and to use your Tradeline Account to pay for this membership. Subject to applicable state law, you agree to automatically renew your Annual Credit Genie Membership on your anniversary date each year and authorize Credit Genie to use your Tradeline Account to pay for this membership with each renewal. Your Credit Genie Membership is subject to the additional Credit Genie Terms.
  2. Purchasing Financial Wellness Products and Services. You may use your Credit Genie Membership and Tradeline Account to purchase and pay for certain financial wellness products and services made available through Credit Genie's platform, subject to availability.

Your minimum payment due each month will include 1/12 of any Credit Genie Membership charged to your account until it is repaid, any purchases made during the billing cycle, and any past due amounts.

1. ACCEPTANCE OF TERMS

By accepting a Tradeline Account, you agree to be bound by the terms of this Agreement.

2. CHANGES TO THIS AGREEMENT

We may amend this Agreement at any time and for any reason in accordance with applicable law. This includes adding, deleting, or changing any provision, including provisions concerning membership terms, interest, or fees. We will provide you with advance notice of changes to this Agreement to the extent required by applicable law.

3. ELIGIBILITY

  1. Be at least 18 years old;
  2. Be a U.S. citizen or lawful permanent resident;
  3. Have a physical address within one of the following states: Alaska, Arizona, Arkansas, Colorado, Florida, Georgia, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Maine, Massachusetts, Michigan, Mississippi, Montana, Nebraska, New Hampshire, New Jersey, New York, North Carolina, Oklahoma, Oregon, Pennsylvania, South Carolina, Texas, Utah, Vermont, Virginia, Washington, West Virginia, Wisconsin, or Wyoming; and
  4. Have a valid Social Security Number (SSN) or Individual Taxpayer Identification Number (ITIN).

4. CONSUMER REPORTS

You authorize us to obtain consumer reports and other information about you in connection with servicing or collecting your Tradeline Account, making you aware of products and services related to your Tradeline Account and for any other purposes not prohibited by applicable law.

You agree that you have read and agree to Credit Genie's Credit Report Access Authorization and Consent, available at: https://creditgenie.com/credit-report-access-authorization-consent/v1.

You understand that Credit Genie may report information about your Tradeline Account to consumer reporting agencies, including your credit limit, payment history, and account status. If your account is closed, we will also report that information. Late or missed payments and closing your account may negatively impact your credit score.

5. YOUR BILLING RIGHTS: KEEP THIS DOCUMENT FOR FUTURE USE

This notice tells you about your rights and our responsibilities under the Fair Credit Billing Act.

What to Do If You Think You Find a Mistake on Your Statement

If you think there is an error on your statement, write to us at:

In your letter, give us the following information:

  • Account Information: Your name and email address.
  • Dollar Amount: The dollar amount of the suspected error.
  • Description of Problem: If you think there is any error on your bill, describe what you believe is wrong and why you believe it is a mistake.

You must contact us:

  • Within 60 days after the error appeared on your statement.
  • At least 3 business days before an automated payment is scheduled, if you want to stop payment on the amount you think is wrong.

You must notify us of any potential errors in writing. You may call us, but if you do we are not required to investigate any potential errors and you may have to pay the amount in question.

What Will Happen After We Receive Your Letter

When we receive your letter, we must do two things:

  1. Within 30 days of receiving your letter, we must tell you that we received your letter. We will also tell you if we have already corrected the error.
  2. Within 90 days of receiving your letter, we must either correct the error or explain to you why we believe the bill is correct.

While we investigate whether or not there has been an error, the following are true:

  • We cannot try to collect the amount in question, or report you as delinquent on that amount.
  • The charge in question may remain on your statement. But, if we determine that we made a mistake, you will not have to pay the amount in question.
  • While you do not have to pay the amount in question, you are responsible for the remainder of your balance.
  • We can apply any unpaid amount against your credit limit.

After we finish our investigation, one of two things will happen:

  1. If we made a mistake: You will not have to pay the amount in question.
  2. If we do not believe there was a mistake: You will have to pay the amount in question. We will send you a statement of the amount you owe and the date payment is due. We may then report you as delinquent if you do not pay the amount we think you owe.

If you receive our explanation but still believe your bill is wrong, you must write to us within 10 days telling us that you still refuse to pay. If you do so, we cannot report you as delinquent without also reporting that you are questioning your bill. We must tell you the name of anyone to whom we reported you as delinquent, and we must let those organizations know when the matter has been settled between us.

If we do not follow all of the rules above, you do not have to pay the first $50 of the amount you question even if your bill is correct.

6. PROMISE TO PAY

You promise to pay us for all purchases made using the Tradeline Account, including Credit Genie Membership charges and other purchases made using the Credit Genie platform, pursuant to the terms of this Agreement.

7. CREDIT LIMIT

Your credit limit is $1,000. This represents the maximum amount in purchases you may have outstanding at any given time. You agree not to go over your Credit Limit. Subject to applicable law, we may increase or decrease your Credit Limit at any time.

8. PURCHASES

You may make purchases using your Tradeline Account on the Credit Genie platform. Your Tradeline Account cannot be used for purchases outside of the Credit Genie platform. We have the right to review and decline any purchase for any reason, including if:

  1. Your Tradeline Account is not current or is in default for any reason; or
  2. The purchase would cause your balance to exceed your available credit.

9. DESIGNATED PAYMENT METHOD

You must designate either a debit card ("Linked Debit Card") or a bank account with ACH capabilities ("Linked Account") for payments on your Tradeline Account. We will only initiate payments that you authorize. You can make payment in the Mobile App. If you turn on AutoPay, you also agree to the AutoPay Terms, available at: https://creditgenie.com/autopay-authorization-and-terms/v1.

10. STATEMENTS

You will be provided with statements at the end of each billing cycle.

11. PAYMENTS

You must pay the minimum payment due on or before each payment due date. The minimum payment due and payment due date will be shown on your statement each month.

  • Calculating your minimum payment due: Your minimum payment due each month will include 1/12 of any Credit Genie Membership charged to your account until it is repaid, any purchases made during the billing cycle, and any past due amounts.
  • No interest or fees: You will not be assessed interest or fees if your payment is late.
  • Prepayment: You may pay all or part of any outstanding balance at any time without penalty.

We may apply payments and credits in any manner we choose.

If you fail to pay your minimum payment due, we may close your Tradeline Account.

12. INTEREST

Your Tradeline Account will not be charged any interest.

13. ACCOUNT MANAGEMENT

You can manage your Tradeline Account through the Credit Genie Mobile App.

14. CLOSING YOUR TRADELINE ACCOUNT

We may close or suspend your Tradeline Account at any time for any reason permitted by applicable law. You may close your Tradeline Account at any time by selecting "Close credit building line" in the Mobile App settings. If your Tradeline Account is closed for any reason, any remaining months of an outstanding Annual Credit Genie Membership will be refunded and applied to your balance. You will remain responsible for all other outstanding balances.

15. AGREEMENT TO RECEIVE INFORMATION ELECTRONICALLY

If you have agreed to our Electronic Document Consent terms terms, we will generally provide notices, disclosures, and other communications to you electronically. If you revoke your consent to receive documents electronically, we may close your Tradeline Account.

You must notify Credit Genie immediately of any change to your contact information by updating your information in the Credit Genie Mobile App.

17. DEFAULT AND TRADELINE ACCOUNT CLOSURE REQUEST

Your account is in default if:

  • you fail to pay any minimum payment due on or before the applicable payment due date
  • any payment you make is returned to us unpaid or cannot be processed
  • you violate any term of this Agreement or any other agreement with us, including Credit Genie Terms
  • you file or become the subject of a bankruptcy or insolvency proceeding

You hereby request us to close your account if you remain in default for 29 days for failing to pay any minimum payment due.

18. MILITARY LENDING ACT

Statement of Military APR

Federal law provides important protections to members of the Armed Forces and their dependents relating to extensions of consumer credit. In general, the cost of consumer credit to a member of the Armed Forces and his or her dependent may not exceed an annual percentage rate of 36 percent. This rate must include, as applicable to the credit transaction or account: The costs associated with credit insurance premiums; fees for ancillary products sold in connection with the credit transaction; any application fee charged (other than certain application fees for specified credit transactions or accounts); and any participation fee charged (other than certain participation fees for a credit card account).

Oral Disclosures

Members of the Armed Forces and their dependents may hear important disclosures and payment information about this Agreement and additional information about whether these protections apply to them by calling 1-877-483-3205.
